1What is a gift deed?
A Gift Deed is a transfer of immovable property, voluntarily between two parties without the involvement of any monetary consideration. The ownership transfer is absolute and is effective as soon as the gift deed is registered.
2What are the documents needed to draft the gift deed and how do I share it with the lawyer?
The property details and relevant property documents like the previous sale or partition deeds, relationship status of the two parties, the two parties address/ID proof, Khatha, Tax Paid receipts etc. will be required by the lawyer to draft the gift deed. The soft copies of these documents can be securely uploaded in the order page.
3What are the stamp duty and other expenses?
In case Blood Relation the Stamp Duty applicable is 1% of the total consideration amount in case of Non Blood Relatives the Stamp duty, cess and surcharge is 5% of the total consideration or Circle Rates whichever is higher as per the prescribed Circle Rates for the city as well as the villages. Additionally, there would be a 2% registration fee. There will be incidental expenses such as scanning charges etc. Kindly note, the legal fees mentioned here is professional fees only and does not include stamp duties, registration fee or any miscellaneous expenses. These expenses have to be paid as per actuals by you.
4How will the legal team help me on the day of registration?
The lawyer will take an appointment with the sub-registrar office on a day convenient to you and will be present throughout to handhold the process. On the registration date along with DD you have to bring original and photo copies of the following documents:
  • You need to pay for for Stamp Duty+ Cess, Surcharge, TDS if applicable and Registration fee to the concerned Sub-registrar.
  • Recent Passport Size Photograph
  • Current Mutation in the names of the seller/s.
  • Seller(s) previous sale deed.
Both seller, buyer and two witnesses (above 22 years) should appear with I.D documents on the registration date.
5How will I get drafted gift deed?
